Code Ann. § 46.2-862, makes clear that authority rests with the trial judge and not the jury to make the lesser degree of culpability determination. <li>The legal standard of probable cause to arrest, as the term suggests, relates to probabilities that are based upon the factual and practical considerations in everyday life as perceived by reasonable and prudent persons. The presence or absence of probable cause is not to be examined from the perspective of a legal technician. Rather, probable cause exists when the facts and circumstances within the officer's knowledge, and of which he has reasonably trustworthy information, alone are sufficient to warrant a person of reasonable caution to believe than an offense has been or is being committed.</li>
<li>When considering a sufficiency of the evidence question not properly preserved at trial, the appellant must do more than show that the Commonwealth failed to prove an element or elements of the offense. Otherwise, an appellate court would be required under the ends of justice exception to address the merits of every case where a defendant has failed to move to strike the Commonwealth's evidence as being insufficient to prove an element of the offense. Such a rule would obviate the requirement for making an adequate motion to strike or a contemporaneous objection that the evidence was insufficient. The exception therefore will not be invoked unless the evidence affirmatively shows that an element of the offense did not occur.</li>

where every commission of the greater offense is also a commission of the
lesser offense, a lesser offense may be deemed to exist. A lesser-included
offense is an offense which is composed entirely of elements that are also

under the Fifth Amendment, U.S. Const. amend. V, Va. Code Ann. § 19.2-294
prevents the Commonwealth from subjecting an accused to the hazards of
vexatious, multiple prosecutions. Contrary to the constitutional double
jeopardy bar, however, the prohibition of § 19.2-294 is dependent upon the
identity of the act, rather than the identity of the offense. Section
19.2-294 speaks to acts of the accused, not elements of the offense.
Moreover, by its terms, § 19.2-294 only bars prosecutions or proceedings after
there has been a conviction. A "prosecution or proceeding" after
a "conviction," by definition requires multiple or successive
proceedings or prosecutions. Many circumstances may determine the time
within which criminal charges are concluded. It is the time of institution
which determines whether multiple charges are simultaneous or successive.
Thus, where charges are brought simultaneously, the amenability of one to
early conclusion while the other requires further proceedings, does not
alter the fact that the proceedings are concurrent, not successive,
prosecutions. Where felony and misdemeanor charges are heard
simultaneously in a single proceeding, they are part of a single
prosecution, even though jurisdictional limitations necessitate that they
be concluded in different courts.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; margin-bottom: 11.55pt; text-align: justify;">In the context of the
double jeopardy bar, considering Va. Code Ann. §§ 46.2-852 and 46.2-817(B)
together, both contain different elements. The reckless driving statute, §
46.2-852, requires that the accused be driving on a highway, whereas the
felony eluding statute, § 46.2-817(B), does not necessitate that the
accused drive on a particular roadway. Section 46.2-852 provides that a
violation may occur if the accused endangers any property of a person.
Section 46.2-817(B), however, provides that a violation occurs only where
the accused endangers the operation of a law enforcement vehicle, but not
the law enforcement vehicle itself. It further requires that the accused
receive a visible or audible signal from a police officer to stop his
vehicle. Moreover, 46.2-817(B), unlike § 46.2-852, proscribes the driving
of the accused only after he has disregarded an officer's signal to stop.
Thus, ifelony eluding and reckless driving constitute separate offenses in
that different facts are required to prove each.<o:p></o:p></li>

prosecution adduces evidence of a particular blood alcohol level to
establish that an appellant was intoxicated and driving recklessly, the
presumptions found in Va. Code Ann. § 18.2-269 become relevant. Therefore,
a jury instruction regarding the statutory presumptions of impairment at
various levels should be granted to the party requesting it.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; margin-bottom: 11.55pt; text-align: justify;">Va. Code Ann. § 46.2-852
does not mention intoxication. Nor does the statute prohibit driving with
a particular blood alcohol level. Evidence of intoxication is a factor
that might bear upon proof of dangerous or reckless driving in a given
case even though it does not, of itself, prove reckless driving.
Therefore, in a reckless driving case, intoxication--not mere consumption
of some alcohol--is relevant to establishing that the defendant drove her
car so as to endanger the life, limb, or property of any person. §
46.2-852. In order to prove intoxication, proof of a defendant's blood
alcohol level may be introduced along with other evidence concerning the
significance of this blood alcohol level.<o:p></o:p></li>

the evidence is challenged on appeal, a reviewing court determines whether
the evidence, viewed in the light most favorable to the prevailing party
and the reasonable inferences fairly deducible from that evidence support
each and every element of the charged offense. In so doing, the reviewing
court must discard the evidence of the accused in conflict with that of
the Commonwealth, and regard as true all the credible evidence favorable
to the Commonwealth and all fair inferences that may be drawn therefrom.
It is the reviewing court's duty to look to that evidence which tends to
support the conviction and to permit the conviction to stand unless
plainly wrong. Indeed, the judgment of a trial court sitting without a
jury is entitled to the same weight as a jury verdict and will not be set
aside unless it appears from the evidence that the judgment is plainly
wrong or without evidence to support it.<o:p></o:p></li>

defined, in pertinent part, as to draw in as a participant, to implicate,
to relate closely, to connect, to have an effect on, to concern directly,
to affect. Nothing in these definitions suggests that, for purposes of
determining criminal liability under Va. Code Ann. § 46.2-894, a driver
must have legally caused an accident in order to be considered
"involved" in the accident. Indeed, the various definitions make
it clear, given the breadth of their scope, that a driver need only be
implicated in or connected with the accident in a substantial or logical
manner to be "involved" in an accident under § 46.2-894.<o:p></o:p></li>

lies not in the act of operating a vehicle, but in the manner and
circumstances of its operation. The mere happening of an accident does not
give rise to an inference of reckless driving. However, physical factors
associated with impact, including extent of damage to vehicles and property
may be considered as mute evidence of high speed.<o:p></o:p></li>

does not mention intoxication. Nor does the statute prohibit driving with
a particular blood alcohol level. Evidence of intoxication is a factor
that might bear upon proof of dangerous or reckless driving in a given
case even though it does not, of itself, prove reckless driving. Therefore,
in a reckless driving case, intoxication--not mere consumption of some
alcohol--is relevant to establishing that the defendant drove her car so
as to endanger the life, limb, or property of any person. § 46.2-852. In
order to prove intoxication, proof of a defendant's blood alcohol level
may be introduced along with other evidence concerning the significance of
this blood alcohol level.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; margin-bottom: 11.55pt; text-align: justify;">The unexplained results
of a blood alcohol test without more do not illumine whether the defendant
was driving recklessly due to intoxication. By itself, such evidence is
irrelevant. In other words, the blood alcohol level indicated in the
preliminary breath test is conditionally relevant, subject to being
"connected up" by other evidence showing that the level indicated
in the test tends to establish that the driver was driving in an
intoxicated condition, so as to endanger the life, limb or property of
others. In addition, there is a significant risk that a jury with nothing
more than a numerical blood alcohol test score might improperly speculate
concerning the significance of the unexplained numerical result of the
preliminary breath test.<o:p></o:p></li>

Defendant, a
previously adjudicated habitual offender in Richmond, was arrested after a
police chase during which he operated a motorcycle at a high rate of speed, in
gross violation of posted limits, approached a group of children as they
crossed the roadway, prompting several to run and, moments thereafter, lost
control, crashed into a fence and fled. At an earlier trial, defendant was
convicted of attempting to elude police but a reckless driving charge was
dismissed. Although reckless driving was a necessary element to the felonious
habitual offender charge, the court held that the commonwealth was not
collaterally estopped from bringing the charge because the record did not
reveal the reason for the earlier dismissal of the reckless driving charge.
Because defendant failed to challenge the indictment in the trial court and the
court found no justification to invoke the ends of justice exception, the court
declined to address defendant's complaint on that issue. The court found the
evidence sufficient to support the finding that defendant's driving endangered
life, limb, or property of others in violation of Va. Code Ann. §
46.2-357(B)(2) and affirmed the conviction.<o:p></o:p></div>

negligent driving and reckless driving is the critical element in
determining punishment under Va. Code Ann. § 46.2-357. In defining the
conduct that gives rise to felony punishment under 46.2-357(B)(2), the
legislature uses the phrase, driving that endangers the life, limb, or
property of another, language virtually identical to that found in the
statute defining reckless driving. Drunk driving does not per se deserve
felony treatment under § 46.2-357. While evidence of intoxication is a
factor that might bear upon proof of dangerous or reckless driving in a
given case, it does not, of itself, prove reckless driving. The essence of
the offense of reckless driving lies not in the act of operating a vehicle,
but in the manner and circumstances of its operation.<o:p></o:p></li>

weaving within in his own lane and into the other lane, the circumstances
support a finding that his driving of itself endangered the life, limb, or
